One Law For All

If 89-year-old John Demjanjuk must stand trial in Germany, where his highly disputable alleged offences did not occur, then why doesn't 88-year-old Warren Anderson have to stand trial in India, where his indisputable offences did occur?

  1. Presumably because the Indian government haven't requested his extradition.

  2. It's not up to the Executive. There has been a court waiting for him for 25 years.

  3. As for Demjanjuk, his alleged offences occurred in a country that at the time was not merely occupied but practically obliterated by Germany - which had every intention of making the acquisition permanent.

In other words, Germany would seem to be a singularly appropriate place to try him - and I don't believe the Poles have raised any objections.

  4. On the contrary, the then occupying power would seem to be quite the least appropriate place.

  5. Up to 1945, I'd entirely agree with you. But I believe there's been a rather sweeping change of regime since then.
