Don't Be Stymied

I am Brexit to my core. And I would rather keep judges out of politics if at all possible, although my only ever experience of a judge has been, and continues to be, entirely positive.

But I am certain that very senior judges do not say "misled" or "improper purpose" by accident, least of all to suggest that the Prime Minister had misled the Queen to an improper purpose.

The High Courts in London and Belfast have considered only whether the decision to prorogue Parliament was justiciable. Only the Court of Session has considered the evidence that has led it to its judgement in relation to that evidence.

Nobody would rule anything out these days, but it strikes me as inconceivable that another bench of very senior judges would, on the same evidence, come to a different conclusion.

If it was enough to make even the Court of Session say that the Prime Minister had lied to the Queen in order to "stymie" Parliament, then it will be enough to make even the Supreme Court say the same thing.

And be warned. Whatever the strict constitutional niceties, if a court in London overturned this ruling in Edinburgh, then it would be one of the sharpest ever nails in the coffin of the Union.

Dominic Cummings and his Maoists of the Right might not care about that. But out in the land that reads the Daily Telegraph and the Daily Mail, they would care about it as much as they cared about the suggestion that anyone, anyone at all, might have lied to the Queen.

Will this kill off Brexit? It is going to do an awful lot of damage. It already has. Another hung Parliament is coming, however, and we need our people to hold the balance of power in it. A new party is now in the process of registration.
